
As reported by the Los Angeles Times, a lawsuit accusing Marilyn Manson (legal name Brian Warner) of sexual assault has been dismissed by a judge.
This lawsuit was filed by Ashely Smithline, a model who had accused Marilyn Manson of sexually assaulting her multiple times back in 2010.
In her lawsuit against Manson, Smithline mentions multiple instances where the rocker allegedly assaulted her; among those instances, Smithline shares that she woke up one time to find her ankles and wrists tied behind her back and that he was penetrating her.
Regarding this recent dismissal, per documents obtained by The Times, U.S. District Judge Fernando L. Aenlle-Rocha dismissed the lawsuit without prejudice; however, Smithline still has the ability to sue Marilyn when it comes to these same allegeations.
Smithline had fired her attorney in October and missed the deadline in notifying the court of a substitute (that deadline being in December).

This case is one of several lawsuits that have been filed against Marilyn Manson.
Back in May of 2022, another lawsuit filed against Marilyn was thrown out; this case was filed by Ashley Walters, an ex-personal assistant who used to work for him. That lawsuit was dismissed on grounds of waiting too long to file the suit.
In March of 2022, actor Evan Rachel Wood appeared on The View and opened up about her past relationship with Manson (who named the rocker as her abuser back in 2021).
Last month, tattoo artist Kat Von D took to social media and voiced her support of Manson, writing, “Innocent until proven guilty should ring very true to us […].”
